SJC decides for teachers in creditable service case

The Massachusetts Supreme Judicial Court has held that teachers may purchase creditable service for prior teaching in a non-public school in the Commonwealth under c. 32, § 4(1)(p), even if they earned social security credits for such service.

The plaintiff teachers in Rosing vs. the Teachers' Retirement System (which combined two additional suits) were employed in teaching positions in private schools that were funded by the state. MTA's Division of Legal Services, which brought this case on behalf of MTA members, is analyzing the new decision and will provide more information on this Website as soon as it is available.
